Assignment Details

In this unit, you are studying the executive branch and the power that the president exercises. The president’s power derives from Article II of the U.S. Constitution, from Acts of Congress and from implied powers. Two of the many ways that a president may choose to exercise their power or authority are through executive orders and administrative agencies. During the 2021–2022 Supreme Court term, the U.S. Supreme Court issued two opinions about vaccine mandates. Both opinions involved the president exercising his power through two different agencies—the Department of Labor (DoL) through the Occupational Safety and Health Administration (OSHA) and the Department of Health and Human Services (HHS).

In the first opinion, National Federation of Independent Business v. Department of Labor, OSHA, the Supreme Court held that OSHA exceeded its powers by imposing a vaccine mandate on an estimated 84.2 million employees in the United States and granted the requested stay.

In a second case, Biden v. Missouri, the Supreme Court upheld the vaccine mandate that was imposed upon health care workers.

Finally, discuss whether you agree or not with the per curiam majority opinion, concurring opinion, or the dissenting justices. Explain your answer in detail.

Finally, discuss whether you agree or not with the per curiam majority opinion or dissenting justices. Explain your answer in detail.
